Heard Mr. D. Das, learned senior counsel, assisted by Mr. S. Das, learned counsel for the petitioner.

2. By filing this contempt petition under section 12 of Contempt of Court Act, 1971, read with Article 215 of the Constitution of India, the wilful disregard and disobedience of the judgment and order dated 20.06.2025, passed in WA 59/2023, WA 333/2021 and WA 126/2020 is alleged.

3. The learned senior counsel for the petitioner has referred to the directions contained in paragraph 140(1) of the said judgment and has submitted that the discharge order in respect of the petitioners were set aside by this Court and therefore, the petitioners could not have been relegated back to the position of Officers on Probation in Assam Police Service vide Notification No.HMA.11/ 2025/181, dated 29.07.2025.

4. Issue notice on the respondent no.3 returnable on 09.02.2026.

5. The petitioner shall take steps within 2 (two) days for service of notice on the respondent no.3 by registered post with A/D.

6. The learned instructing counsel for the petitioner is granted liberty to collect the postal receipt number from the Registry and submit postal track Page No.# 3/3

report prior to the next date of listing.

7. It may be stated that at this stage, notice has not been issued on the respondent nos.1 and 2.

8. List on 09.02.2026.
