Crl. A. 59/2022 and Crl.A.(J)) 48/2022 have been filed by the same appellant, namely, Lalu Tanti @ Ajit Tanti against the same impugned judgment and order dated 03.03.2022, passed by the learned Sessions Judge, Sontipur, Tezpur, in Sessions Case No. 186/2016, by which the appellant has been convicted under Section 302 of the IPC and sentenced to undergo rigorous imprisonment for life with a fine of Rs.10,000/-, in default to undergo simple imprisonment for three months.
2. Ms. M. Sutradhar, learned counsel appears on behalf of Mr. R. Baruah, learned counsel for the appellant in Crl. A. 59/2022 and prays for adjournment.
3. On the other hand, Mr. M. K. Hussian, learned counsel appears on behalf of the appellant in Crl.A.(J)) 48/2022 and Ms. S. H. Borah, learned Addl. Public Prosecutor appears for the State.
4. In view of the fact that there cannot be two appeals filed by the appellant against the same impugned judgment convicting under Section 302 of the IPC, we are of the view that one of the appeals would have to be closed, as not Page No.# 3/3
being maintainable. As Crl.A.(J)) 48/2022 had been filed earlier in point of time than Crl. A. 59/2022, we close Crl. A. 59/2022.
5. Mr. M. K. Hussian, learned counsel for the appellant in Crl.A.(J)) 48/2022 is furnished with a copy of the paper book.
6. Ms. S. H. Borah, learned Addl. Public Prosecutor submits that she has already been served a copy of the paper book.
7. Consequently, Crl. A. 59/2022 stands closed. Crl.A.(J)) 48/2022 be listed for hearing on 03.12.2025.
