Heard Mr. T. Kalita, learned counsel for the applicant. Also heard Mr. M. Talukdar, learned counsel for the opposite party no. 1.

This is an application filed under Order XLI Rule 5 of the Code of Civil Procedure praying for stay of the operation of the impugned judgment and order dated 01.03.2024 passed by the learned Member, MACT, Cachar, Silchar in MAC case no. 86/2018.

Since the connected appeal has been admitted, the operation of the impugned judgment and order dated 01.03.2024 passed by the learned Member, MACT, Cachar, Silchar in MAC case no. 86/2018, shall remain stayed subject to the condition that the applicant/appellant shall deposit the entire awarded amount of Rs. 1,16,506/- before the Registry of this Court within 6 (six) weeks from today.

On such deposition made, the respondent/claimant shall be allowed to withdraw the same on proper identification by the Advocate.
