Heard Mr. J.U. Ahmed, learned counsel for the applicant. Also heard Mr. R.B. Bora, learned counsel for the respondent No. 1.

By way of this Interlocutory Application, the applicant is seeking impleadment of the new incumbent/opposite party No. 2, i.e. Sri Akash Deep, IAS, Principal Secretary, Bodoland Territorial Council, Bodofa Nwgwr, Kokrajhar, B.T.A.D., Assam, Pin-783370 as contemnor/respondent No. 2 in Cont.Cas(C) No. Page No.# 3/3

720/2022.

It appears that during the pendency of the contempt proceedings, the contemnor No. 1, i.e. Sri Anurag Goel, IAS, Principal Secretary, BTC has been transferred from the post of Principal Secretary, BTC and in his place, Sri Akash Deep, IAS has joined as the Principal Secretary, BTC.

It further appears that after the new incumbent joined the subject post, the applicant on 20.08.2024 submitted a representation alongwith the Judgment & Order dated 25.02.2022 passed by this Court in WP(C) No. 1283/2022 requesting him to release the due amount in terms of the aforesaid Judgment & Order dated 25.02.2022.

It further appears that despite the representation being sent, the order of this Court has not been complied. It appears that the new incumbent is required to be arrayed as a contemnor in this contempt proceeding.

Accordingly, the impleadment application is allowed.

It is provided that Sri Akash Deep, IAS, Principal Secretary, Bodoland Territorial Council, Bodofa Nwgwr, Kokrajhar, B.T.A.D., Assam, Pin - 783370 be impleaded as contemnor/respondent No. 2 in Cont.Cas(C) No. 720/2022.

Let the amended cause title be submitted in the Contempt Petition before the Registry for doing the needful.
