This is an appeal under Section 100 of the Code of Civil Procedure, 1908 challenging the judgment and decree dated 18.05.2009 passed in Title Appeal No. 12/2008 whereby the judgment and decree dated 24.03.2008 passed by the learned Court of Munsiff, Bajali, Pathsala in Title Suit No. 1/2007 was upheld.

2. It is seen that the records were called for vide an order dated 31.05.2010 but till date the LCR of Title Appeal No. 12/2008 have not been received.

3. The Registry of this Court shall forthwith take steps for requisitioning of the LCR of Title Appeal No. 12/2008 and also seek an explanation from the learned Court of Civil Judge, Barpeta as to why the records have not been sent.

5. The Registry as well as the learned Court of Civil Judge, Barpeta shall ensure that the records of Title Appeal No. 12/2008 is available before this Court on the next date.
