1. Heard Ms. A Biyani, learned counsel for the applicant/appellant.
2. This present application has been filed for correction of order dated 03.01.2024 in the Interlocutory Application No. 2571 of 2018 in the connected M.A.C Appeal No. 653 of 2018.
3. Ms. A Biyani, learned counsel for the applicant/appellant has submitted that an appeal have been preferred against the judgment and award dated 12.08.2018 passed by the Ld. Member, M.A.C.T No. 3, Kamrup (M), Guwahati in M.A.C Case No. 258 of 2014 awarding a sum of Rs. 57,103/- to the opposite party/claimant.
4. The appellant had also filed an Interlocutory Application for stay of operation of the judgment and award dated 12.01.2018 passed by the Ld. Member, M.A.C.T No. 3, Kamrup (M), Guwahati in M.A.C Case No. 258 of 2014.
5. The stay petition was numbered as I.A.(Civil) No. 2571 of 2018 and the same was disposed of by this Court vide order dated 03.01.2024. It is submitted that in the order dated 03.01.2024, this Court had, inadvertently, recorded the date of judgment and award and M.A.C Case wrongly. The petitioner/appellant herein, therefore, prays that the inadvertent typographical error of judgment and award and the M.A.C Case number and the name of the M.A.C.T needs to be corrected in the order dated 03.01.2024 passed in I.A.(Civil) No. 2571 of 2018. Hence, the present application.
6. This Court has perused the pleadings and heard the submissions of the learned counsel and it is therefore directed that in the last paragraph of order dated Page No.# 3/3
03.01.2024, the impugned judgment date may be corrected as 12.01.2018 and the Ld. Member, M.A.C.T No. 3, Kamrup (M), Guwahati in M.A.C Case No. 258 of 2014 is to be substituted instead of the order date/M.A.C number/Tribunal name written in the order dated 03.01.2024.
7. In terms of the above observations, this Interlocutory Application stands disposed of.
