                                     BEFORE
                     HONOURABLE MR. JUSTICE KAUSHIK GOSWAMI

                                            ORDER

Date : 18-08-2025

Heard Mr. A. Gohain, learned counsel for the applicant. Also heard Ms. U. Sarma, learned counsel appearing for the respondent No.3.

2. By way of this application, the applicant is seeking correction of this Court's order dated 19.06.2024 passed in WP(C) 2053/2022.

3. Learned counsel for the applicant submits that due to an inadvertent communication error, the reference of the petitioner's work order in the judgment and order dated 19.06.2024 was wrongly recorded, for which, the present Interlocutory Application has been filed for correction of the said judgment and order.

4. Ms. U. Sarma, learned counsel for the respondent does not oppose to the prayer made in this instant appeal.

5. Paragraph 5, 6 and 7 of the application reads as under:-

5. That the applicant/petitioner begs to state that there is an inadvertent mistake on the site of the learned counsel for the applicant/petitioner that it was unfortunately left out to communicate the Hon'ble Court about the petitioner's work order for which in the aforesaid Hon'ble Court judgment dated 19-06-2024 it was wrongly recorded the petitioner's work order as No. SA.KA.ΑΟ/Rangia/Sashwa Bharat Mission/57/2017-18/777 dated 21-03-17 in place of No. SA.KA.AO/ Rangia/Sashwa Bharat Mission/58/2016-17/9200 dated 21-03-2017.

Page No.# 3/3

6. That the applicant/petitioner begs to state that it is an inadvertent mistake and there is no deliberate laches and negligence on the part of the counsel for the applicant. It is further stated by the applicant that it had only come to the knowledge to the applicant that when the respondent authorities communicated the applicant/petitioner and informed about the aforesaid mistake happened in the Hon'ble Court judgment dated 19-06-2024 passed in WP(C) 2053/2022.

7. That the humble applicant begs to state that the petitioner is in severe financial hardship due to non-payment of the aforesaid contractual amount to the petitioner. Therefore, the humble applicant prays before this Hon'ble Court that the Hon'ble Court may be corrected/modified the Hon'ble Court's order dated 19-06-2024 passed in WP(C) 2053/2022 so far the petitioner's work order is concerned and may be recorded the petitioner's work order as work order/Letter No. SA.KA.AO/Rangia/Sashwa Bharat Mission/58/ 2016-17/9200 dated 21-03-2017 in place of work order/Letter No. SA.KA.AO/Rangia /Sashwa Bharat Mission/57/2017-18/777 dated 21.03.2017 and passed such further order or orders which Your Lordships may deem fit and proper for the ends of justice."

6. Reading of the aforesaid it appears that in the judgment and order of this Court dated 19.06.2024, the petitioner's work order inadvertently has been recorded as "No. SA.KA.AO/Rangia/Sashwa Bharat Mission/57/2017-18/777 dated 21.03.2017" in place of "No. SA.KA.AO/ Rangia/Sashwa Bharat Mission/58/2016-17/9200"

7. That being so, in the interest of justice, the order dated 19.06.2024 warrants to be corrected.

8. It is accordingly provided that in the judgment and order dated 19.06.2024, the petitioner's work order shall now read as " No. SA.KA.AO/ Rangia/Sashwa Bharat Mission/58/2016-17/9200 dated 21-03-2017" in place of "SA.KA.AO/ Rangia/Sashwa Bharat Mission/57/2017-18/777 dated 21.03.2017"

9. This order shall now be a part of the order dated 19.06.2024.

10. With the above observation and direction, the I.A. stands allowed and disposed of.
