counsel for the applicant. Also heard Ms. S Saha, learned counsel for the respondent.

The accompanying appeal has been filed against the Judgment and Order dated 28/10/2024 passed by the Principal Judge, Family Court No. 1, Kamrup (M), Guwahati in F.C (Civil) Case No. 209/2017 under Section 27(1)(b) & (d) of the Special Marriage Act, 1954. In filing the statutory appeal, a delay of 13 days has occurred and therefore this interlocutory application has been filed praying for condonation of the delay.

The learned counsel for the respondent does not object to the delay.

Upon considering the submissions of the learned counsel for the parties and upon perusal of the grounds urged in support of the prayer for condonation of the delay and in absence of any specific objections from the respondents to the contrary and also considering the law laid down by the Apex Court in N. Balakrishnan Vs. M. Krishnamurthy reported in (1998) 7 SCC 123, this Court considers it appropriate to condone the delay, as prayed for.

Accordingly, the delay of 13 days which had occurred in filing the connected appeal is condoned.

Accordingly, the interlocutory application stands disposed of.

The Registry is directed to register the accompanying appeal and list it thereafter.
