Heard Shri J. Das, learned counsel for the applicant, who by means of this application filed under Section 5 of the Limitation Act, 1963 has prayed for condonation of delay of 13 days up to 29.10.2024. The appeal has been preferred against the judgment dated 17.08.2024 and order of conviction and sentence dated 22.08.2024 passed by the learned Special Judge, Goalpara in Special (P) Case No. 61 of 2021 convicting and sentencing the applicant to undergo rigorous imprisonment for 20 years and to impose a fine of Rs. 30,000/- (Rupees Thirty Thousand) only and in default of payment thereof to suffer simple imprisonment for a further period of 4 (four) months for the offence under Section 6 of the POCSO Act, 2012.

Let notice be issued, returnable by 6 (six) weeks.

Ms. A. Begum, learned Addl. Public Prosecutor, accepts notice on behalf of the State respondent.

Let steps for service of notice upon the respondent No. 2 be taken Page No.# 3/3

through the Registry of this Court in the manner prescribed within 3 (three) days from today.
