Heard Mr. I.U. Choudhury, learned counsel for the appellant and Ms. A. Begum, learned Additional Public Prosecutor for the respondent no. 9, State of Assam.
2. The instant criminal appeal under provision of Section 132, Code of Criminal Procedure, 1973 is preferred against a Judgment and Order dated 18.05.2024 passed by the Court of learned Additional Sessions Judge, Bilasipara [trial court] in Sessions Case no. 102/2012. By the Judgment and Order dated 18.05.2024, the respondent nos. 1 to 8 who faced the trial, have been acquitted from the charges framed against them under Sections 143, 147, 148, 149/302, Indian Penal Code [IPC].
3. We have perused the contents of the memorandum of appeal.
4. The criminal appeal is admitted for hearing.
5. The case records of Sessions Case no. 102/2012 be called for.
6. Issue notice, returnable in 4 [four] weeks.
7. As Ms. Begum, learned Additional Public Prosecutor has appeared and accepted notice on behalf of the respondent no. 9, State of Assam, the issuance of formal notice to the respondent no. 9 stands dispensed with.
8. The appellant shall take steps of service of notice upon the respondent no. 1 to 8 by registered Page No.# 4/4
post with A/D as well as by usual process within 3 [three] working days.
