Heard Mr. K.K. Bhatta, learned counsel for the applicant and Ms. A. Bora, learned counsel for respondent No. 1 and Ms. J. Ghosh, learned counsel for respondent Nos. 2 and 3.

This is an application under Section 5 of the Limitation Act praying for condonation of delay of 20 days in preferring the connected appeal against the judgment and award dated 31.05.2023 passed in MAC Case No. 7 of 2017 by the learned Member, Motor Accident Claims Tribunal, Nagaon in MAC Case No. 7 of 2017.

The delay in not preferring the connected appeal on time has been explained in para 3 of the condonation petition.

Upon perusal of the said explanation, this Court is satisfied that the applicant has been able to show sufficient cause for not preferring the connected appeal within a stipulated time. Moreover, the learned counsel for respondent has no objection if the delay of 20 days in preferring the connected appeal is condoned.

Accordingly, delay of 20 days in preferring the connected appeal is hereby condoned.

Office shall register the connected appeal and place for admission on a Page No.# 3/3

date to be fixed by Registry.
