Heard Mr. A. Paul, learned counsel for the petitioner. Also heard Mr. P. Borthakur, learned Additional Public Prosecutor for the State of Assam.

This criminal revision petition is filed under Section 397 of the Code of Page No.# 2/2

Criminal Procedure, 1973 assailing the Judgment and Order dated 16.06.2023 passed by the learned Additional Sessions Judge, Jorhat, Assam in Sessions Case No. 30 (JJ)/2015 under Section 302 of IPC arising out of G.R. No. 1781/2014 convicting the petitioner to undergo rigorous imprisonment for a period of 2 (two) years along with fine of Rs. 25,000/- and in default to undergo further rigorous imprisonment for 4 months for commission of offence under Section 304 Part-II of IPC.

Issue notice returnable after six weeks.

As Mr. Borthakur, learned Additional Public Prosecutor accepts notice on behalf of the State respondent, no formal notice need be issued to the said respondent.

LCR be called for.

Considering the matter in entirety and the period of sentence, in the interim, till return of such notice, the petitioner is allowed to remain on previous bail granted to him during the trial by the learned Court below.
