This application under Section 374 Cr.P.C., is preferred against the judgment and order, dated 06.01.2022, passed by the learned Sessions Judge, Page No.# 2/2

Morigaon in Sessions Case No.96/2015. It is to be noted here that vide impugned judgment and order, the learned Court below has convicted the petitioner under Section 354 IPC and sentenced him to suffer rigorous imprisonment for 1(one) year and to pay a fine of Rs. 2000/- with default stipulation and also convicted under Section 448 IPC, but, the learned Court below has not imposed any sentence upon him under Section 448 IPC, but, directed that both the sentences to run consecutively.

Heard Mr. P. J. Saikia, learned counsel for the petitioner and also heard Ms. N. Das, learned Additional PP for the State respondents.

Let notice be issued returnable in 4(four) weeks.

Steps be taken by registered post with A/D as well as by usual process.

Since, Ms. N. Das, learned Additional PP, entered appearance on behalf of the State respondent no.1, no formal notice is required to be issued. However, requisite extra copy of the petition be furnished to her during the course of the day.
