Heard Mr. M. Talukdar, learned counsel for the applicant and Mr. T. Kalita, learned counsel for the respondent Insurance Company.

The present application has been filed praying for a direction to the Insurance Company to deposit 50% of the awarded amount, in respect of the judgment and award dated 01.12.2020 passed by the learned MACT Silchar in MAC Case No. 770/2015, in the Registry of this court. Mr. Talukdar further submits that the claimant should be given the liberty to withdraw the same from Registry.

Mr. Kalita submits that the Insurance Company has no objection if the prayer of the applicant is allowed.

Considering the submissions made by the learned counsel for both the sides, the Insurance Company is directed to deposit 50% of the awarded amount in the Registry within six weeks.

After deposition of the aforesaid amount, Rs. One lakh each shall be fixed deposited in the names of the two applicants for a period of three years and the applicants shall be at liberty to withdraw the rest of the amount on proper identification.

With the aforesaid direction, the I.A. stands disposed of.
