Heard Mr. A Dutta, learned counsel for the appellant and Mr. A Shakil, learned counsel appearing on behalf of respondent No.1.

This is an application under Order XLI Rule 27 of the CPC to adduce additional evidence.

Issue notice, returnable by 4 (four) weeks. Steps upon respondent No.2 by Registered Post with A/D as well as through usual process within 3 (three) days.

Taking into consideration the judgment of the Supreme Court rendered in the case of Union of India Vs. Ibrahim Uddin reported in (2012) 8 SCC 148, this Court shall take into consideration the said application at the time of hearing of the appeal.

As Mr. A Shakil, learned counsel accepts notice on behalf of respondent No.1, so no notice need be sent to respondent No.1, however, extra copy of the application be served upon the learned counsel for the aforesaid respondent within 3 (three) days.
