Heard Mr. U.K. Nair, learned senior counsel, assisted by Mr. A.M. Borbhuiya, learned counsel for the petitioner. Also heard Mr. J. Handique, learned standing counsel for the Revenue (Registration) and Disaster Management Department, representing the respondent nos. 1 to 4, and Mr. D. Das, learned senior counsel, assisted by Mr. M.H. Laskar, learned counsel for respondent no.5.

It is seen that the petitioner has assailed the appointment of respondent no.4 to the post of Muslim Marriage Registrar & Kazi (hereinafter referred to as "MMR &K" for short) at Sonai, District Cachar. However, as per the cause title of the writ petition, the respondent no.4 is the District Registrar, Cachar, Silchar, Assam and that the said authority is not the MMR&K.

This fact was not brought to light when the matter was heard. Hence, though the matter was reserved for judgment, but the same could not be pronounced.

Therefore, the petitioner shall do the needful, as he may be so advised.

The matter shall not be treated as part-heard.
