Heard Mr. I.H. Saikia, learned counsel for the appellant and Mr. D. Das, learned Additional Public Prosecutor, Assam for the respondent State of Assam.
This appeal under Section 374[2], Code of Criminal Procedure, 1973 [CrPC] is directed against the judgment and order dated 16.11.2018 passed by the Court of learned Additional Page No.# 2/2
Sessions Judge no. 2 [FTC], Tinsukia ['the trial court', for short] in Sessions Case no. 141[T]/2015. By the said judgment and order, the learned trial court has convicted the accused-appellant under Section 354[A][2], Indian Penal Code [IPC] and the accused- appellant has been sentenced to undergo rigorous imprisonment for 2 [two] months and to pay a fine of Rs. 10,000/-, in default of payment of fine, to undergo rigorous imprisonment for another 3 [three] months.
The appeal is admitted for hearing.
Since the LCR has been received and the parties are represented, list the appeal for hearing in usual course.
