Heard Mr. D. Chakrabarty, learned counsel for the petitioner and Mr. H. Sarma, learned Standing counsel, APDCL for the respondent Nos. 1 to 3.

Petitioner by filing an additional affidavit shall annex the copy of the plaint of Title Suit No.22/2018, copy of the Judgment and Decree passed in Title Suit No.37/2016, copy of the the written statement filed in said T.S. No.22/2018 and the copy of the Misc. (Inj.) Case No.16/2018 filed by the plaintiff under Order XXXIX Rules 1 and 2 read with Section 151 of the Code of Civil Procedure, wherein the order dated 20.09.2018 was passed by the learned Court of Civil Judge, No.2, Cachar, Silchar and also the objection, if any, filed by the defendant therein.

Registry shall list this matter for motion, only after filing such additional affidavit by the petitioner.
