      HON'BLE MR. JUSTICE SUNIL GAUR

                         ORDER

(ORAL)

Quashing of FIR No. 93/2014, under Sections 420/467/468/471/384/120-B of IPC and Section 12 of Indian Passport Act, registered at police station Economic Offences Wing, Delhi is sought on merits. It is brought to the notice of this Court that petitioner is contesting the extradition proceedings pending against him before the Court in Spain.

Before petitioner can be heard in this petition, the outcome of the extradition proceedings is required to be seen. Petitioner relies upon Supreme Court's decision in Inder Mohan Goswami & Another vs. State of Uttaranchal & Others 2007 (10) SCR 847 to submit that petition seeking quashing of this FIR ought to be entertained, even when non- bailable warrants have been issued against the accused.

Upon hearing, I find that Supreme Court's decision in Inder Mohan Goswami (Supra) has been rendered in altogether totally different context and has no application to the instant case.

Accordingly, this petition and the applications are disposed of as pre-mature, with liberty to petitioner to file similar petition, after the outcome of extradition proceedings is known.

(SUNIL GAUR) JUDGE JANUARY 28, 2019 v
