1. Petitioners seek anticipatory bail in FIR No. 282/2018 under Sections 452/323/341/427/34 of the IPG, Police Station Ghazipur, New Delhi.
2. The allegations in the FIR against the petitioners are that the co- accused had entered into the office of the complainant and had an altercation with the complainant and his brother and assaulted them with sticks. The petitioner is alleged to have also entered into the office and assaulted the complainant and his brother with sticks.
3. Learned counsel for the petitioners submits that the petitioners have been falsely implicated and false allegations have been made in the FIR as
the co-accused who is alleged to have assaulted is aged over 50 years of age and is not in a position to even walk properly. It is submitted that the co- accused Ankit and Aakash are on regular bail and co-accused Ravi has been granted interim protection of anticipatory bail.
4. Vide order dated 30.07.2018, the petitioner was granted interim protection subject to his joining investigation.
5. Learned Addl. PP, under instructions, submits that the petitioner did join the investigation and investigation has been concluded and charge sheet is being finalised and shall be filed shortly.
6. Without commenting on the merits of the case, and on perusal of the records, I am satisfied that the petitioner has made out a case for grant of anticipatory bail.
7. Accordingly, it is directed that in the event of arrest, the arresting officer/IO/SHO shall release the petitioner on bail on his furnishing a bail bond in the sum of Rs. 15,000/- with one surety of the like amount to the satisfaction of the arresting officer/Investigating Officer/SHO concerned. Petitioner shall not do anything that may prejudice either the trial or the prosecution witnesses.
8. The petition is disposed of in the above terms.
