SANJEEV SACHDEVA, J. (ORAL)

1. Petitioner seeks anticipatory bail in FIR No. 192/2018 under Sections 308/34 of the IPC registered at Police Station Kalyan Puri, New Delhi.

2. Allegations in the FIR are that the complainant along with his friend had gone to the locality of the accused to collect donations for holding a religious function. It is contended that accused confronted the complainant and his friend and thereafter an altercation took place wherein the complainant and his friend were assaulted.

3. Learned counsel for the petitioner submits that the petitioner has been falsely implicated as there is a financial dispute between the complainant and the petitioner. He further submits that the nature of injuries alleged to have been sustained were simple and the injured were discharged on the same day.

4. Vide order dated 30.07.2018, the petitioner was granted interim protection subject to his joining investigation.

5. Learned Addl. PP, under instructions, submits that the petitioner did join the investigation and investigation has been concluded and chargesheet is being finalised and shall be filed shortly.

6. Without commenting on the merits of the case, and on perusal of the records, I am satisfied that the petitioner has made out a case for grant of anticipatory bail.

7. Accordingly, it is directed that in the event of arrest, the arresting officer/IO/SHO shall release the petitioner on bail on his furnishing a bail bond in the sum of Rs. 15,000/- with one surety of the like amount to the satisfaction of the arresting officer/Investigating Officer/SHO concerned. Petitioner shall not do anything that may prejudice either the trial or the prosecution witnesses.

8. The petition is disposed of in the above terms.

9. Order Dasti under signatures of the Court Master.
