SANJEEV SACHDEVA, J. (ORAL)

Crl. M.A. 28696/2018 (Exemption)

Allowed, subject to all just exceptions.

CRL.M.C. 3778/2018

1. The petitioner seeks quashing of FIR No. 111 of 2018 under Sections 308 of the IPC registered at Police Station Jagatpuri, Delhi,

based on a settlement.

2. The subject FIR was registered consequent to a quarrel which took place between the parties. The respondent no. 2/complainant is father-in-law of the petitioner.

3. Learned counsels for the parties submit that the parties have amicably settled their disputes. The petitioner and the son of Respondent No. 2/complainant are now residing together as husband- wife.

4. Respondent no. 2 is present in court in person and is identified by the Investigating Officer. Respondent no. 2 submits that he has reconciled the dispute with the petitioner and does not wish to prosecute the complaint against the petitioner any further and has no objection to the quashing of the subject FIR.

5. In view of the fact that the disputes between the petitioner and respondent no. 2 have been settled, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would be expedient to quash the subject FIR and the consequent proceedings emanating there from.

6. In view of the above, the petition is allowed. FIR No. 111 of 2018 under Sections 308 IPC registered at Police Station Jagatpuri, Delhi and and the consequent proceedings emanating there from are, accordingly quashed.

7. Order Dasti under signatures of the Court Master.
