                             JUDGMENT

26.02.2018 SANJEEV SACHDEVA, J. (ORAL) CRL.M.C. 4366/2017

1. Respondent No.2 has been served, however, none appears for respondent No.2.

2. It is contended by learned counsel for the petitioner that the subject FIR was registered as far back as in the year 1997. Charge sheet in the subject FIR though dated 08.09.2000 was filed on 31.05.2002 and Charges were framed on 11.09.2015 and only one

prosecution witness has been recorded till date. Learned counsel submits that the petitioner has faced prosecution for over 20 years and he prays for a direction for expediting the trial.

3. Keeping in view the fact that the subject FIR was registered in the year 1997 and Charge sheet was filed in the year 2002, substantial delay has occurred in the prosecution of the case. It is not the case of the prosecution that the petitioner has been instrumental in delaying the proceedings. The entire blame for delay in prosecution does not falls on the petitioner.

4. Keeping in view the above facts and the fact that the FIR was registered over 20 years ago, the Trial Court is directed to expedite the proceedings and preferably conduct the same on a day-to-day basis and conclude the same preferably within a period of four months from today.

5. The Petition is disposed of in the above terms.

6. Order Dasti under signatures of the Court Master.
