                                     JUDGMENT

17.04.2017

SANJEEV SACHDEVA, J. (ORAL)

CM No.11349 /2017 (exemption)

Exemption is allowed subject to all just exceptions.

W.P.(C) 2627/2017

1. The petitioner, by the present petition, seeks a direction to the respondents to take action with regard to the issuance of food card No.004491, which is allegedly obtained on the basis of the forged

signatures of the grandfather of the petitioner.

2. Further direction is sought to conduct specific enquiry regarding the food card issued to respondent No.5.

3. The contention of the petitioner is that respondent No.5, who is residing in a portion of the property, in which the petitioner also resides, has obtained a Food Card allegedly on the basis of the forged signatures of the grandfather of the petitioner. The petitioner has made complaints to several authorities with regard to the said Food Card issued and contends that no action has been taken. However, it is stated by the petitioner that the Food Card has already been cancelled.

4. Since the Food Card has already been cancelled, it appears that action has been taken by the authorities on the basis of the complaints made by the petitioner.

5. With regard to the directions issued by the Public Grievances Commission in Appeal No.44/2013/PGC/DRI/F&S, vide order dated 24.09.2013, is concerned, it is noticed that the appeal of the petitioner has been dismissed on the ground that the representation dated 06.03.2013 of the petitioner is incomprehensible and that the Food & Supply Department was not required to take any action in respect of the decision of the Central Information Commission (CIC) dated 30.03.2009, no directions were issued in the appeal. The appeal was accordingly disposed of.

6. The petitioner, who appears in person, submits that he is not impugning order dated 28.09.2013 of the Appellate Authority, Public Grievances Commission.

7. Since the Food Card has already been cancelled and the petitioner is also not impugning the order passed by the Appellate Authority, Public Grievances Commission, no relief survives in this petition.

8. In view of the limited prayers made in this petition, the grievances of the petitioner with regard to alleged forgery and alleged non-supply of information under the Right to Information Act, 2005 do not arise for consideration in the present petition.

9. The Writ Petition is accordingly dismissed.

10. Dasti under the signatures of the Court Master.
