1. The present petition has been listed by the Registry subject to an office objection with regard to its maintainability with an observation that the petitioner ought to have approached the Central Administrative Tribunal for seeking appropriate relief against the respondent No.1 / Ministry of Health and Family Welfare and respondent No.2/National Institute of Health and Family Welfare, Govt. Of India, both governed under Section 14 of the Central Administrative Tribunals Act, 1985.
2. Counsel for the respondents hands over a Notification dated 25.10.2007, issued by Ministry of Personnel, Public Grievances and Pensions (Department of Personnel and Training), Govt. of India, wherein the respondent No.2 has been mentioned at Sr. No.65. A copy thereof has been furnished by the learned counsel for the respondent to counsel for the petitioner, who seeks leave to withdraw the present petition, while reserving the right of the petitioner to approach the Central Administrative Tribunal for appropriate relief.
3. Leave as prayed for, is granted. The writ petition is dismissed as withdrawn along with pending applications.
