1. Counsel for the plaintiffs states that in view of the settlement
arrived at with the defendant through the court annexed mediation
and recorded in the Settlement Agreement dated 13.4.2015 placed on
record, the plaintiffs seek leave to withdraw the present suit.
2. Leave, as prayed for, is granted. The suit is disposed of.
3. At this stage, counsel for the plaintiffs states that as the parties
have arrived at a settlement through the court annexed mediation, the
plaintiffs are entitled to refund of the court fees.
4. Having regard to the fact that when the suit is at the stage of
recording of evidence, the parties had been referred to mediation, the
plaintiffs are held entitled to refund of 50% court fees under Section
16A of the Court Fees Act.
5. Registry is directed to issue a certificate of refund of 50% court
fee to the plaintiffs under Section 16A of the Court Fees Act.
6. File be consigned to the record room.
