JUDGMENT
B.C. Patel, C.J.
1. This petition is filed in public interest, inter alia, praying to bring legislation, policy, rules and regulations, preventing print and audio visual media to adopt a code of conduct regarding commercialisation of sex in media, advertisements and its vulgarisation as an entertainment etc. It is also prayed to legalise prostitution business with certain terms and conditions regarding their medical fitness, age, identity, specific area of operation etc.
2. There is no material whatsoever with regard to prayer (h) and thus this issue cannot be considered in the present petition. It is open to the petitioner to file an appropriate petition with material regarding this prayer. In so far as the other prayers are concerned, one has to look to the provisions contained in the Indian Penal Code as also the Indecent Representation of Womens (Prohibition) Act, 1986, Cinematographic Act. All these statutes provide appropriate remedy and punishment. Authorities are also separate under different statutes. Reading the provisions contained in these Acts, the court is of the opinion that Public Interest Litigation cannot be entertained as specific remedies are provided under the Act. This petition is rejected.
However, it does not mean that the petitioner cannot approach the Magistrate/Competent Authority for appropriate relief by filing proper complaint.
