1. Both of these writ petitions have been preferred by the
petitioners seeking regularisation. However, it would be
appropriate to notice paragraph 6 of the return filed by
respondents No. 1 to 3/State, which provides as
under :-
"6. It is respectfully submitted that in
compliance of the directions of the Hon'ble
Court and in light of the circular issued by the
State Government dated 07/03/2012 as well
as the policy of the State Government dated
05/03/2008 the case of the petitioners have
been duly considered by the respondent No.
4/Mata Rukmini Sewa Sansthan, Dimrapal
and on due verification the services of the
petitioners have prepared a list of eligible and
ineligible candidates for regularization in the
regular establishment of the Contingency
Fund. Thereafter the said list has been
forwarded to the District Education Officer of
the concerned District i.e. District Sukma,
Narayanpur, North Bastar Dantewada and
Bastar (Jagdalpur) for further necessary action.
The District Education Officer in turn had
forwarded the said proposal/report to the
Director, Directorate of Public Instructions,
Chhattisgarh for appropriate orders and at
present the said proposal is pending
consideration before the Director, Directorate of
Public Instructions... "
2. In that view of the matter, since the matter is pending
consideration before the Director, Directorate of Public
Instructions for appropriate order, it is hereby directed
that the Director, Directorate of Public Instructions will
consider and decide the case of the petitioners within 45
days from the date of receipt of a copy of this order
absolutely in accordance with law by passing a reasoned
and speaking order. It is made clear that this Court has
not expressed any opinion on the merits of the matter.
3. With the aforesaid direction, this writ petition stands
finally disposed of. No cost(s).
