Heard on I.A. No.1 of 2024, application for suspension of sentence and grant of bail to the appellant.

By the impugned judgment dated 27/11/2024, passed by the learned Additional Sessions Judge Baikunthpur, District Koriya (C.G.) in Sessions Trial No 33/2024, the appellant stands convicted and sentenced as under :-

                                              Under Section 294               R.I. for 3 months.

        Under Section 506              R.I. for 6 months.

        Under Section 307              R.I. for 5 years and fine amount of

Rs.1000/-, in default of payment of of IPC fine additional RI for 1 month.

                                       All the sentences           shall   run
                                       concurrently.

Learned counsel for the appellant submits that appellant is in jail since 17/02/2024, the appeal is likely to take more time for its final adjudication and he furnish adequate security and shall abide all the directions and conditions imposed by the Court, hence he may be enlarged on bail.

On the other hand, learned State counsel has opposes the submission made by counsel for the appellant and submits that the injured was admitted in the hospital for about 18-20 days and was not able to speak properly, therefore his application may not be allowed.

Considering the maximum sentence awarded to the appellant i.e. five years R.I. and he served the sentence of one year, the injury caused by the appellant is serious in nature, therefore, the application I.A. No.1/2024, deserves to be and is hereby rejected.

List this case for final hearing.
