Heard on I.A. No.01/2025, which is an application

seeking for suspension of sentence and grant of bail.

Learned counsel for appellant submits that the

appellant has already served about four months of

substantive jail sentence during trial and after the judgment.

Maximum jail sentence awarded to appellant is one year

and there is no other criminal antecedents against the

appellant. Hence, jail sentence awarded to him be

suspended.

Learned State counsel opposes the submission of

learned counsel for appellant, however, submits that there

is no other criminal antecedents against the appellant.

Considering the submissions made by learned

counsel for appellant, nature of allegation, I am inclined to

allow I.A. No. 01/2025.

Accordingly, I.A. 01/2025 is allowed. It is directed that

substantive jail sentence of appellant shall remain

suspended during pendency of this appeal and he be

released on regular bail upon furnishing bail bond in the

sum of Rs. 25,000/- with one surety in the like sum to the

satisfaction of concerned Court below, for his appearance

before the Registry of this Court on 27th October, 2025.

Thereafter, he shall appear before the trial Court on the

date given by the Registry of this Court and will continue to

appear there on all such dates before trial Court till disposal

of this appeal.
