2. The appeal CRA No.387/2023 (Lumesh Kosare v. State of

Chhattisgarh), preferred by the appellant against the impugned

judgment of conviction and order of sentence dated 01.12.2022 by

engaging counsel of his own choice and the instant criminal appeal i.e.

CRA No.258/2023 ( Lumesh Kosare v. State of Chhattisgarh) has been

filed with the assistance of High Court Legal Aid Committee against the

same impugned judgment.

3. Since criminal appeal i.e. CRA No.387/2023 preferred by the appellant

by engaging a counsel of his own choice against the same impugned

judgment of conviction and order sentence dated 01.12.2022 is

pending consideration before this Court, the instant criminal appeal i.e.

CRA No.258/2023 is unnecessary and accordingly, it stands disposed

off. Mr. Ravi Kumar Banjare, learned counsel, is requested to submit

the paper book to this Court which was supplied to him and the

Registry is directed to serve the same to Mr. Amit Kumar, learned

counsel, who is appearing on behalf of the appellant in CRA

No.387/2023.
