   1.

This Criminal Revision is filed against the judgment dated

3.12.2019, passed by the learned Third Additional Sessions Judge,

Raigarh, District Raigarh in Criminal Appeal No.68/2018, whereby

the appeal preferred by the applicant has been dismissed and the

judgment of conviction and order of sentence recorded by the

learned Judicial Magistrate First Class, Raigarh in Criminal Case

No. 2839 of 2011 dated 5.2.2018 has been affirmed. The

appellant has been convicted and sentenced as under:-

             Conviction                             Sentence
          Under Section 332 of the      R.I. for 1 year and fine of
          Indian Penal Code.            Rs.500/- and in default of
                                        payment of fine, additional R.I.
                                        for 1 month.
           Under Section 506 part-II     R.I. for 6 months and fine of
           of the Indian Penal Code.     Rs.200/- and in default of
                                         payment of fine, additional R.I.
                                         for 10 days.





                  Under Section 294 of the      RI for 1-1 month and fine of
                  Indian Penal Code (two        Rs.100-100/- and in default of
                  counts)                       payment of fine, additional R.I.
                                                for 5-5 days.

All the sentences are to be run concurrently.

1. Learned counsel for the applicant would submit that the present

applicant has served the entire sentence inflicted upon him.

2. Learned counsel for the State would submit that on verification

from Jail Department, it is informed that the present applicant has

been released from jail on 8.9.2020 after serving the entire jail

sentence.

3. As the present applicant has already served the entire sentence,

this petition has become infructuous.

4. Consequently, the revision petition is dismissed being rendered

infructuous.
