1) The appeal is arising out of the judgment of conviction and order of sentence dated 24.09.2021 passed by the Special Judge, NDPS Act, in Special Criminal Case No.34/2018 and the appellant has been convicted and sentenced under Section 20 (B) (ii-C) of NDPS Act.

2) At the outset, learned counsel appearing for the appellant seeks to withdraw this appeal as another criminal appeal i.e. CRA No.1444 of 2021 has been preferred by the same appellant through his counsel namely Shri Vikash Pradhan, Advocate. Which is pending consideration before this Court.

3) Counsel for the State has no objection to the above prayer.

4) Permission granted.

5) Accordingly, the instant appeal being not maintainable, is

disposed of as withdrawn.

6) Registry is directed to publish the name of Smt. Itu Rani, Advocate alongwith Shri Vikash Pradhan, Advocate as counsel for the appellant in CRA No. 1444 of 2021.
