1. As both the appeals are arise out of the common judgment they
are being disposed of by this common judgment.
2. The aforesaid appeals have been preferred by the
appellant/husband - Saket Kumar Ravi challenging the judgment and
decree simultaneously passed in two cases i.e. one passed in Civil
Suit No.4-A/2016 on 06.02.2020 (Saket Kumar Ravi Vs. Sartia Ravi)
and second passed in Civil Suit No.9-A/2016 dated 06.02.2020 (Sarita
Vs. Saket Kumar Ravi), whereby the Civil Suit No.4-A/2016 filed by the
appellant/husband under Section 13 of the Hindu Marriage Act, 1955
(for short "the Act") for dissolution of marriage was dismissed and the
Civil Suit No.9-A/2016 filed by the respondent/wife for restitution of
Conjugal Rights was allowed.
3. During the pendency of these appeals the wife has preferred
the execution application for restitution of conjugal rights before the
executing court which was registered as Case No.6/2022. Thereafter,
the case was listed before Lok Adalat, District Balrampur,
Ramanujganj held on 12.03.2022. On the said date the compromise
was arrived at between the parties and they have settled their dispute
and stated to be living together and the appellant has taken his wife
with him.
4. Today on instructions, it is stated by the counsel for the parties
that both are living happily and residing together and as settlement has
been arrived at between the parties, there is no purpose to continue
the present appeals. It is submitted by the counsel for the appellant
that in terms of compromise arrived at between the parties, he does
not want to pursue these appeals.
5. In view of submission made by the parties and considering the
terms of compromise dated 12.03.2022, these appeals are disposed
of.
6. A decree be drawn accordingly. Both the parties shall bear their
own cost(s).
