Learned counsel for the appellants would submit that Pramod Chand Akhilraj Banwar who is benefiary of gift deed has been arrayed as legal representative of deceased Smt. Lilly Banwar in Civil Suit No. 8-A/84 which was renumbered as Civil Suit No. 235-A/ 1997 decided by the 5th Civil Judge, Class II, Ambikapur on 6-11- 1998. An appeal was preferred against the said judgment and decree before the learned 2nd Additional District Judge, Ambikapur which was registered as Civil Appeal No. 119-A of 2002 and same was decided on 19-4-2003. Against that order, second appeal was preferred before this court being Second Appeal No. 299 of 2003 which was dismissed as withdrawn by the appellant in the year 2015.

Learned counsel for the appellant would further submit that records of Civil Suit No. 235-A/97 and Civil Appeal No. 119-A/2002 are required for proper adjudication of the present case.

Let the aforesaid records be requisitioned immediately. List this case after three weeks.
