1) The appeal is arising out of the judgment of conviction and order of sentence dated 04.12.2021 passed by the First Additional Sessions Judge, Ramanujganj, District- Balrampur-Ramanujganj (C.G.) in Sessions Case No R- 93/2016 and the appellant has been convicted and sentenced under Sections 450, 506-II & 376 of IPC.
2) At the outset, learned counsel appearing for the appellant seeks to withdraw this appeal as another criminal appeal i.e. CRA No.1647 of 2021 has been preferred by the same appellant namely Lohar Saay Bhagat through his counsel Shri Neeraj Mehta, Advocate. Which is pending consideration before this Court.
3) Counsel for the State has no objection to the above prayer.
4) Permission granted.
5) Accordingly, the instant appeal being not maintainable, is disposed of as withdrawn.
