Heard on I.A. No. 01/2021, application for grant of Stay.

Counsel for the appellant submits that the Trial Court while convicting the appellant for the offence under Section 26(2)(ii) of Food Safety and Standard Act, 2006 has sentenced him to fine of Rs. 1 Lakh which is too harsh. The appellant has a good case on merits, disposal of the appeal is likely to take some time and if the sentence part is not stayed, it would cause undue hardship to the appellant.

On the other hand, State counsel opposes the stay application and supports the impugned judgment.

Considering the facts and circumstances of the case and the entire material available on record, this Court is not inclined to grant stay. Accordingly, the application (I.A. No. 01/2021) is rejected.

List this case for final hearing on 25/01/2022.
