1) The present appeal i.e. CRA No. 1247/2021 and previously filed appeal CRA No.1232/2021 are arising out of the same judgment of conviction and order of sentence dated 30.09.2021 passed by the Special Judge (SC/ST Act) Surguja (Ambikapur) (C.G.) in Special Sessions (Atrocities) Case No.64/2019. Previously filed appeal i.e. CRA No.1232/2021 has been preferred by the same appellants namely Ram Kumar Jaiswal & Raghunandan @ Pappu Jaiswal. Since two appeals against the same judgment of conviction and sentence are not maintainable, in the facts and circumstances of the case, the appeal i.e. CRA No. 1247/2021 is dismissed as not maintainable.

2) List CRA No.1232/2021 for hearing in its due course.
