Since learned State Counsel accepts notice on behalf of all the Respondents, issuance of notice to them stands dispensed with.
Let reply be filed by Respondents within six weeks. Further heard on I.A. No.1 - application for grant of interim relief. Taking into consideration the judgments of the Hon'ble Supreme Court in the case of Stanzen Toyotetsu India Private Limited v. Girish V. & Ors, [2014 (3) SCC 636], Divisional Controller, Karnataka State Road Transport Corporation v. M. G Vittal Rao [2012 (1) SCC 442], Avinash Sadashiv Bhosle (Died) through LRs. v. Union of India [2012 (13) SCC 142], State Bank of India & Ors. v. Neelam Nag and Others [2016 (9) SCC 491] and also a couple of decisions rendered by this Court, prima facie, a strong case for grant of interim relief to Petitioner is made out.
Accordingly, it is ordered that there shall be a further stay of Departmental Enquiry proceeding till the next date of hearing.
List for hearing immediately after the reply of Respondents is received.
