This Court finds that the matter is of 2021 and time and again

this Court has continuously fixed date for examination of the defendant's

witness. The matter was fixed on 4th December, 2021. The examination-in-

chief of the defendant's witness could not be completed. Accordingly, the

examination-in-chief was deferred and the matter was fixed on 19 th January,

2021 and 21st January, 2021 but on 21st January, 2021 again the

examination-in-chief was not completed and the case was adjourned and

fixed on 19th of March, 2020 and 20th March, 2020 as specially fixed matter

for examination of the defendant's witness. Today when the matter is called

again the defendant is praying for time. This Court finds that the defendant

is dragging the matter instead of making any endeavor to bring witness for

examination.

2. Accordingly, the examination-in-chief of the defendant's witness

is closed and fixed for argument.

3. After the order passed by this Court the learned Counsel for the

defendant time and again praying for fixing any other dates so that he can

examine the witness. Considering the submissions made by Counsel for the

defendant the order is recalled and this Court finds that one further

opportunity is given to the defendant for examination of the witness.

4. Let the matter appear on 9th April, 2026 at 3.45 p.m. for

examination of defendant's witness subject to payment of costs of

Rs.1,00,000/-(One Lakh) to the State Legal Services Authority within a week

from date.
