        The Court :- Pursuant to the direction made by the Coordinate Bench

on September 10, 2025, Mr. Debdut Mukherjee, learned Advocate

appearing for the defendant submits that the defendant was delayed by one

day in affirming the evidence on affidavit.

        For the ends of justice, the delay stands condoned. By extending the

time, the evidence on affidavit filed in Court today, is taken on record. Copy

has already been served upon the plaintiff, though delayed.

        To expedite the further procedure in the suit, the cross-examination

of the plaintiff's witness to be done by the defendant shall take place

through commission.

       Accordingly, Ms. Dipanwita Ghosh, learned Advocate, a Member of

the Bar (Contact No. 9432597571) is appointed to hold the commission.

The commission shall not take more than four sessions, as submitted by the

learned Advocate appearing for the defendant.

       The consolidated remuneration of the learned Commissioner shall be

paid by the defendant for a total sum of Rs.60,000/-.

       In the event, the sessions spread over more than four, then the

parties shall mention the matter before this Court upon notice to each other,

for fixing additional remuneration for the Commissioner.

       Immediately after conclusion of the commission, the learned

Commissioner shall prepare and file a report before this Court. In that event

also, the parties shall be at liberty to mention the matter upon notice to

each other, for filing the report.
