SUVASISH DASGUPTA AND ORS.

BEFORE:

The Hon'ble JUSTICE MADHURESH PRASAD And The Hon'ble JUSTICE PRASENJIT BISWAS Date: 26TH FEBRUARY, 2026.

Appearance:

Ms. Dasgupta, Adv.; Mr. V.Chatterjee, Adv., for petitioner in item 7 & for cross objector in item 8.

Mr. S. Das, Adv.; Mr. S. Roy, Adv., for UCO Bank.

1. The Court: GA/1/2025 is an application in APOT/295/2025 for condonation of

delay in preferring the appeal. There is a delay of 78 days. Having regard to the

averments made in the application read with the supplementary affidavit filed

thereto, we accept the sufficient cause shown for condonation of the delay as it

appears that the appellant had pursued for filing the appeal diligently and delay

has occurred on account of a bonafide delay in obtaining the certified copy and

we condone the delay. GA/1/2025 accordingly stands allowed.

2. GA/1/2025 is an application filed in OCOT/12/2025 for condonation of delay in

preferring the cross appeal. The delay is stated to be of 21 days. The miniscule

delay has been explained in the application and we find that sufficient cause has

been shown for condoning the delay as the appellant had pursued for filing the

cross appeal diligently and the delay has occurred bona fide. We condone the

delay in filing the cross appeal. GA/1/2025 accordingly stands allowed.

3. In the appeal and the cross appeal, we exempt filing of formal paper books since

we are informed that the stay applications include all the documents from the

writ court records.

4. List the appeal and the cross appeal for further consideration with a view to their

final disposal on 19.03.2026.
