The Court:- This is a suit for disparagement, infringement and passing off.

The petitioner seeks reliefs, inter alia, restraining the respondent from

displaying or airing the impugned advertisement which had been launched by

the respondent depicting a deceptively similar product as that of the petitioner's

product 'HARPIC' its bottle shape and its associated trade dress. The impugned

advertisement relates to a newly launched product by the respondent i.e.,

"Godrej Spic".

The respondent is represented.

On behalf of the respondent, an unconditional undertaking is given that

they do not intend to continue with the impugned advertisement and would take

immediate steps to refrain from advertising or displaying the same in any mode

or manner. Hence, insofar as the impugned advertisement is concerned, no

order is passed in view of the above undertaking.

Heard the parties on the remaining ad interim reliefs. List this matter

under the heading "For Orders" on 25 February, 2026.
