parte judgment and decree dated 23rd March, 2011 allowing the counter claim of the

defendant and dismissing the suit of the plaintiff. A prayer for condonation of delay of

seven months is also there. None appears for the defendant. Cogent reasons are given.

Delay is condoned. Ex-parte judgment decree allowing counter-claim is set aside and

ex-parte order of dismissal of the plaint case is also set aside. In nutshell, allowing the

instant application the ex-parte judgment and decree dated 23.03.2011 is hereby set

aside.

Let the matter appear on 2nd February, 2024 for further order.
