The Court: In terms of the order dated 27th September, 2023, Mr. Megnad

Dutta, Advocate, was appointed as a Special Referee to proceed with enquiry of

mesne profit.

Learned Counsel for the plaintiff submits that the name of Mr. Dutta may

be substituted by any other suitable Advocate as she has an instruction from

his client.

The learned Counsel for the defendants submits that according to the

judgment dated 9.12.2014, the cost shall be borne by the plaintiff and

consolidated remuneration shall also be provided by the plaintiff.

Miss. Debjani Roy, Advocate, Bar Library Club (Mob: 9433714737) may be

appointed as a Special Referee to enquire into mesne profit. Consolidated

remuneration of the learned Special Referee shall be Rs.50,000/- to be borne by

the plaintiff. All incidental expenses shall also be borne by the plaintiff in terms

of the judgment dated 9.12.2014. The Special Referee shall complete the enquiry

into mesne profit within a period of three months.

Ms. Chakraborty, erstwhile Special Referee will hand over all the

documents and papers to the newly appointed Special Referee.

Let the matter appear in the combined monthly list of January, 2024.
