petitioner in WPA 19481 of 2022 and Mr. Ali Ahsan
Alamgir, learned counsel for the petitioner in rest of
the writ petitions made their further submissions on
the issue by relying upon latest Division Bench
judgment of this Court dated April 13, 2023 delivered
in MAT 1594 of 2018 and a judgment of the Hon'ble
Supreme Court in the matter of Rishal and others
Vs. Rajasthan Public Service Commission & Ors.
reported at (2018) 8 Supreme Court Cases 81. They
also relied upon a judgment passed by a co-ordinate
Bench in W.P. 23006(W) of 2017 in the matter of
Prativa Mondal Vs. The State of West Bengal &
Ors. delivered in a bunch of writ petitions. Both the
learned counsel appeared for the petitioners as named
above shall file their respective written notes of
argument in the matter on or before May 16, 2023.
Mr. Prosenjit Mukherjee, learned counsel for
the Madrasah Service Commission had replied in
counter to the submission made on behalf of the
petitioners. He shall also file a written notes of
argument on May 16, 2023.
These series of writ petitions shall appear
under the heading "For Orders" on May 17, 2023.
