It is submitted on behalf of the appellant that the instant appeal arises from the judgment having pronounced on admission under Order XII Rule 6 of the Code of Civil Procedure and, therefore, justice would be sub-served if the appeal is disposed of. It is further submitted that all the relevant papers relied on by the Commercial Court below are annexed with the stay application. It is also submitted that paper book has already been prepared and filed in Court and, therefore, the appeal may be treated as ready.
The respondent is appearing, and, therefore, there is no necessity to serve separate notice of appeal upon the respondent. The notice of appeal is dispensed with.
