The Special Messenger cost was put on in
compliance with the order of this Court. The Special
Messenger reached to the concerned office of the learned
Tribunal. The report received from the concerned office
and it appears from the report that after the disposal of
the instant M.A.C. case, record was sent to the District
Record Keeper and in spite of thorough search, the said
record could not be traced out till date. This being the
scenario and it appears that the instant M.A.C. is only
pending for ascertainment that whether the
compensation awarded by the Tribunal was deposited by
the Insurance Company or not.
The instant appeal has been preferred against the
judgment and order dated 07.08.2012 passed by the
learned Additional District Judge, 5th Court, Nadia being
M.A.C. Case No.6 of 2006 (Ms. Nurjahan Bewa Vs.
Oriental Insurance Company Ltd. & Ors.).
The learned Tribunal has awarded a sum of
Rs.1,55,500/- in favour of the claimant alongwith 6%
interest per annum from the date of the impugned order.
To ascertain whether the awarded amount was
deposited or not; the parties are directed to submit a
specific report to that effect by August 29, 2023.
List the matter on August 29, 2023.
All parties shall act on the server copy of this
order duly downloaded from the official website of this
Court.
