On the submission of the learned Advocate for the
judgment-debtors that urgent steps have been taken for
correction of the defect in the special leave petition filed before
the Hon'ble Apex Court and around two months' time would
be required to move the matter, this Court is of the view that
the order dated July 18, 2023 passed by the learned Civil Judge
(Senior Division), 2nd Court at Barasat, North 24-Parganas, in
Title Execution Case No.12 of 2023, requires modification.
Hence, the revisional application is disposed of with a
direction that the title execution case shall be kept in abeyance
for a period of three months from date of communication of
this order. If during the aforementioned period, no order is
passed in favour of the judgment-debtors on the special leave
petition, the learned executing court shall prepone the next
date of hearing on an application to be filed by the petitioner
and fix necessary dates for expeditious adjudication of the
execution case. The execution case shall be disposed of within
a period of four months from the date of filing of the
application.
The revisional application is, thus, disposed of.
There will be, however, no order as to costs.
Parties are to act on the basis of the server copy of this
order.
