The grievance of the petitioner is that the
CESC Limited is refusing to give electricity
connection to the petitioner on the ground of splitting
of load, although the petitioner is entitled, in her own
right as a tenant, to get a new electricity connection
at the tenanted premises.
Learned counsel appearing for the CESC
Limited contends that there are Division Bench
judgments, which provide that issues regarding
splitting of load have to be referred to the concerned
Grievance Redressal Officer (GRO).
However, since learned counsel for the
petitioner also seeks to rely on judgements of co-
ordinate Benches for the proposition that a tenant is
entitled, in her/his individual capacity, to take a new
electricity connection at the tenanted premises and
that the question of splitting of load with the landlord
does not arise in such circumstances, learned
counsel are requested to come prepared on the said
issue and cite the relevant judgements on the next
returnable date.
The matter shall next be enlisted under the
same heading on May 17, 2022.
